New Mexico’s State Congress remains divided on the legality of sports betting in the Land of Enchantment. 2021 saw one measure to legalize sports betting throughout the state, but it ultimately didn’t go anywhere.

Tax on Sports Winnings in New Mexico

The State of New Mexico imposes a tax excise of 10%, known as the gaming tax. Gross receipts belonging to gaming device manufacturers and the distributors of gaming devices are taxed in this way.

In addition, New Mexico taxes gambling winnings. This tax consists of a 26% tax on gaming, a 20% tax on racing purses, and a 0.25% tax related to problem gambling.

New Mexicans face a six percent tax on net sports winnings. New Mexico hasn’t formally passed any specific legislation for sports gambling taxes. The six percent refers to the regular state income tax.
