Is Sports Betting Legal in New Mexico?

Sports Betting in New Mexico officially became legal on October 16, 2018. This makes New Mexico the sixth state to offer legal sports betting at various brick and mortar gambling establishments throughout the state. The reason for this is that, technically speaking, sports betting in New Mexico isn’t legal, but at the same time, is legal. Santa Ana Casino was the first of the tribal New Mexico casinos with sports betting options, and launched the new addition in 2018.

Santa Ana Casino, which belongs to the Pueblo of Santa Ana Tribe, felt confident in moving forward with NM sports betting, as it is not illegal to do so within their tribal gaming compacts with the state. Since then, no less than four other NM tribes have gone ahead and now also offer legal sports betting options in New Mexico.

Here’s a brief timeline of legal sports betting in New Mexico:

  • 2018: Santa Ana Casino becomes the first Indian tribal casino to offer legal sports betting in the state (despite no official law on record).
  • 2019: New Mexico Lottery is prevented from launching a sports betting game of its own. While there was no bill to legalize sports betting in the state, there were bills to prevent NM Lottery from creating their own sports betting facilities.
  • 2020: An article published in the Navajo Times reported that the Navajo Gaming Enterprise is working with a view to launch their own legal sports betting within the state. To date, the Navajo have three brick and mortar casinos operating within the state.

Gambling Tax in New Mexico

The State of New Mexico imposes a tax excise of 10% known as the gaming tax. This gaming tax of 10% applies specifically to gaming devices. Gross receipts belonging to gaming device manufacturers as well as the distributors of gaming devices are taxed in this way. This extends to the sale, lease or transfer of any gaming devices into and throughout the NM state. In addition, New Mexico taxes gambling winnings. This tax consists of a 26% tax on gaming, a 20% tax on racing purses, and a 0.25% tax related to problem gambling.
