Is Sports Betting Legal in New Mexico?

Sports Betting in New Mexico officially became legal on October 16, 2018. This makes New Mexico the sixth state to offer legal sports betting at various brick and mortar gambling establishments throughout the state. However, New Mexico sports betting is somewhat of an anomaly when compared to other states that offer legal sports betting.

The reason for this is that, technically speaking, sports betting in New Mexico isn’t legal, but at the same time, is legal. This is because only tribal casinos have been given the right to offer legal Sports betting in New Mexico. Santa Ana Casino was the first of the tribal New Mexico casinos with sports betting options, and launched the new addition in 2018.

Santa Ana Casino, which belongs to the Pueblo of Santa Ana Tribe, felt confident in moving forward with NM sports betting, as it is not illegal to do so within their tribal gaming compacts with the state. Since then, no less than four other NM tribes have gone ahead and now also offer legal sports betting options in New Mexico.

Here’s a brief timeline of legal sports betting in New Mexico:

  • 2018: Santa Ana Casino becomes the first Indian tribal casino to offer legal sports betting in the state (despite no official law on record).
  • 2019: New Mexico Lottery is prevented from launching a sports betting game of its own. While there was no bill to legalize sports betting in the state, there were bills to prevent NM Lottery from creating their own sports betting facilities.
  • 2020: An article published in the Navajo Times reported that the Navajo Gaming Enterprise is working with a view to launch their own legal sports betting within the state. To date, the Navajo have three brick and mortar casinos operating within the state.

Gambling Tax in New Mexico

The State of New Mexico imposes a tax excise of 10% known as the gaming tax. This gaming tax of 10% applies specifically to gaming devices. Gross receipts belonging to gaming device manufacturers as well as the distributors of gaming devices are taxed in this way. This extends to the sale, lease or transfer of any gaming devices into and throughout the NM state. In addition, New Mexico taxes gambling winnings. This tax consists of a 26% tax on gaming, a 20% tax on racing purses, and a 0.25% tax related to problem gambling.

What Sports Can You Bet On in New Mexico?

Sports betting in New Mexico is wide and varied, although there are no local major league sports teams based in New Mexico itself. As far as local sports team betting is concerned, residents of NM must rely on college-level sports teams. However, that isn’t always an option at every sportsbook within the state. For instance, Santa Ana Star does not accept any wagers on University of New Mexico or New Mexico State sporting events. On the other hand, other sportsbooks like the one at Isleta Resort do accept a wide variety of wagers on events hosted by those schools. It’s worth noting that these decisions are not made by the sportsbook operator, but rather by the local casino itself.

That said, when it comes to online sports betting, the parameters are much wider and the number of sports and sporting events is much more varied. For example, Bovada covers a wide range of NFL and college football, along with all NBA action, MLB and college soccer. You’ll find that with our top ten online sports betting New Mexico options, virtually everything is covered, from the latest  PGA golf, to ice hockey (NHL and NCAA), tennis, horse racing, MMA, boxing, politics, and much more.

Esports Betting in New Mexico

Esports is quickly becoming one of the most popular forms of sports betting all over the world. However, while sports betting is very popular in New Mexico, the legal status of betting on eSports is unclear at this stage. Moreover, while there is nothing in NM state law that deals with eSports, there is no eSports betting on offer at any New Mexico gambling and sports betting location. This will be so until operators are able to get clarification on the matter.

That said, you will find plenty of the latest eSports betting action at any of our top recommended online sportsbooks. Just by way of example, SportsBetting.ag is currently featuring FIFA soccer championships, along with some of the most popular eSports including DOTA2, Counter-Strike, King of Glory, and Valorant. You’ll find even more top eSports betting action at our other recommended online New Mexico sports betting sites.

Types of Betting Markets

While you’ll find all sorts of great betting markets at top sportsbooks, both online and brick and mortar, the following betting markets are among the most widespread and popular.

This is the easiest bet of all that you can make. A moneyline bet is ideal for beginners, or those looking for a quick and easy bet. A moneyline bet is essentially betting on a team to win.

Point Spread

Instead of just betting on a team to win (outright), you are now betting on a team’s margin of victory. For example, if one team is stronger than the other team, the likelihood of them winning is higher. They then become the favorite to win. On the other hand, the weaker team is more likely to lose, and so are the underdog.

In order to make the bet more interesting, the sportsbook will add a minus point figure to the favorite, while adding a plus figure to the underdog.

For example:

Team A -7.5 (favourite to win)
Team B + 7.5 (underdog)

So the favorite must win by more than 7.5 points to win the bet. On the other hand, the opposing team that is priced at +7.5 must either win the game outright, or lose by fewer than 7.5 points.

Over/Under (Totals)

Also known as a point total, over/under bets are also very easy to make. Here, you are betting on a total number of points over or under a certain number. This bet is the combined number of points scored between both teams.

For example:

A football match between the Eagles and the Giants, the sportsbook sets the point total at 45.5 points.

Regardless of which team wins or loses, your bet is on the total number of points scored between them. Let’s say the score ends up at Eagles 17 and Giants 21, the total number of points scored is 38. If you bet on under, your bet would win, since the total score is under 45.5.

Here your bet is actually a bet on multiple bets to win. These are popular in a number of sports including horse racing, soccer and American football. For a parlay bet to win, every leg (bet) has to win in order for you to win the parlay. If you get three legs in, but the fourth leg loses, you lose the parlay bet or ticket. Parlays are popular because they require a lower dollar bet for a potentially higher dollar win.

Similar to a parlay bet as it is also tied to multiple bets. However, the main difference here is that it only applies to point spreads and pays out in the same way a regular single bet would. The name comes from the practice of “teasing” the spread of multiple games by one or more points in favor of the bettor.

Prop Bets

Also known as a proposition bet, props bets is a kind of bet that does not tie in directly to who wins the game or what the final score will be. Instead, prop bets focus on other aspects, such as game props or player props. This can include betting on the performance of a certain player, how many yards a certain quarterback might gain, or how many rebounds an NBA player might accumulate and so on. These would fall under player prop bets. Game prop bets relate to events within the game, how many corners a soccer team might get in the first half, or which team will score a certain amount before half time and so on.

Bonuses at New Mexico Sportsbooks

Our top recommended New Mexico sports betting sites feature a wide range of interesting sports betting bonuses and useful incentives. These are especially useful if you’re just starting out with your sports betting adventure, as they can give you a good starting boost. In addition, free bet promotions are great for testing the waters when you first begin to explore some of the betting options that come with sports betting.

While sports betting bonuses can be quite varied, and often depend on each individual sportsbook, the following will give you a good idea of some of the most common or popular sports betting promotions.

Matched Deposits

Matched deposits are very common, and you’ll find them at most good New Mexico gambling sites, including both sports betting sites and online casinos in New Mexico alike. As the name of this bonus type implies, the operator will match the amount that you deposit (over and above the minimum required) by a certain percentage.

The percentage amount is dependent on the site. For example, MyBookie currently offers a matched deposit of 100% up to $1,000. This means that, whatever you decide, the deposit will be automatically doubled (100%), up to a maximum amount of $1,000. On the other hand, a sports betting site like Bovada will give you a 50% match up to a maximum amount of $250. This essentially means that they will add half the value of your deposit amount as an added bonus to your total deposit value.

Free Bets

Like matched deposit bonuses, free bet bonuses require a qualifying deposit. However, each bookie will do this a bit differently. For example, BetOnline is currently running two different free bet offers. The first is their risk-free player props wager, which applies to a first time bet (your first bet) on their new player props software. The second is their live betting $25 free play offer. In both examples the value of the free bet is $25 and, as is the case with most free bets, you’ll be required to place your bet with your own money. However, if your bet doesn’t win, they’ll give you a free bet in your account worth $25.

No Deposit Bets

No deposit bets are free bets that a sportsbook will give to you as a new customer. The difference here is that you do not need to make a cash deposit with the first in order to qualify for the free bet.

Bonus Offer Promo Code Min Odds Expiry Date
MyBookie 100% up $1,000 MYB100 30 days
BetUS 50% up to $1,000 SB1000 30 days
BetOnline 50% up to $1,000 BOL100 30 days
Bovada 50% up to $250 30 days
Xbet 100% up to $500 XB100 30 days

Deposit & Withdrawal Methods for New Mexico Betting

Our top online sports betting New Mexico picks for you all feature a wide selection of safe and convenient payment methods for instant deposits and quick withdrawals. You’ll notice that more and more NM sportsbooks are now offering the ease, security, and convenience of cryptocurrencies, with top sportsbooks like Bovada, Xbet, and MyBookie all offer not only Bitcoin but Litecoin and Bitcoin Cash as well. Of course, all of the classic payment options are available across the board, including Visa, MasterCard, and American Express. Those that prefer getting a ‘check in the mail’ will enjoy the Check by Courier service that Bovada offers. While this method takes the longest (around 15 days) you may prefer a physical payment over a digital one.

As it stands, payout times do vary considerably, and it all depends on what payment type you decide to go with. All sportsbooks will run payout times from one hour (usually crypto), to 24 hours (Person2Person, PayPal etc), to up to 15 days (check, bank wire etc). Similarly, minimum deposits and withdrawals are usually also dependent on the chosen payment method. For instance, MyBookie varies their minimum deposit requirement from around $20 to $100, depending on what you decide to go with. This also applies to their minimum withdrawal amount, which works according to your ‘customer level’ with them (how long you’ve been with them/VIP status).

The following table gives an overview of the type of payment methods, expected payout times, and minimums relating to our top ten New Mexico sportsbooks:

New Mexico Mobile Betting Apps

Since becoming legal in 2018, sports betting in New Mexico continues to increase in 2021 and beyond. This goes for mobile sports betting as well, as we see the trend worldwide towards being able to bet on the go either via a convenient mobile sports betting app, or directly via a browser-level mobile betting platform. Our top ten recommended online sports betting sites for NM all feature world-class mobile sports betting access.

Whether you prefer your Android mobile phone or tablet or enjoy iOS mobility (iPhone, iPad), accessing mobile sports betting apps is easy and safe. In fact, our top sportsbook recommendations use the latest mobile browser technology, allowing instant access even for those using Blackberry and some Windows Phone mobile devices. Mobile sports betting gives you all of the features and options that you would be able to enjoy via your standard desktop access, including free bets and other promotions, pre-match and live betting platforms, safe and secure mobile payment options, mobile support, and much more.

Live Betting & Streaming in New Mexico

Live betting and streaming of major sporting events is one of the best ways that you can enjoy sports betting in New Mexico today. While not every online sports betting site will offer streaming services, virtually all of them will offer live betting. This is not the same as pre-match betting, which has been the standard for decades. Live betting takes sports betting to the next level, by allowing punters to place bets while the action is taking place. Thanks to some great advances in technology, live betting opens up a whole new realm of possibilities, allowing for up to the second props bets and much more. Take a look through our list of top recommended NM sportsbooks to see what they have to offer in this regard. While you will find great live streaming services at bookies like BetOnline and Intertops, sites like GTBets and BetNow still offer fantastic live betting platforms with up to the minute live updates on all major sports including NFL, NBA, MLB, live soccer, live tennis, and much more.

How to Compare New Mexico Sportsbooks

With so many good New Mexico gambling and betting sites to choose from, it can be tricky to pick the one that offers the best features for your specific needs. This is why you should always compare as many options against each other as possible. In this way, you will be able to select the best option based on practical criteria, which we’ve listed here for your convenience.

Range of markets

The range of available markets is an important consideration, and will also depend on your own personal tastes and interests as far as sports betting is concerned. If you only follow one or two sports, say NFL and NBA or MLB, then choosing a sportsbook with a vast range of markets isn’t really important, as long as they are able to offer every betting option, and cover both pre-match and live betting within those specific sports. For example, MyBookie does great when it comes to offering a wide range of markets on North American sports, with plenty of action in NCAA, NFL, NBA, NCAAF, and NHL. On the other hand, if horse race betting is more your thing, going with a site like BetUSR is ideal, since their main focus is US horse racing as well as plenty of international horse racing fixtures, with top early odds and great betting markets.

Sports betting bonuses come in all shapes and sizes from slightly smaller welcome bonuses like Bovada’s 50% up to $200 sign up bonus, to MyBookie’s 100% up to $1,000. However, it is important to also look beyond the initial welcome bonus to see what else a sportsbook might have on offer in terms of ongoing promotions for regular customers. For example, Xbet offers an initial sign up bonus of a 100% bonus match up to $500. However, beyond that, regular customers can enjoy a 7% rebate on horse race betting, weekly reload bonuses of up to $250, and casino bonuses, including weekly reload bonuses of up to $1,000 and more. Aside from the actual monetary value of the bonus, it is also important to check the T’s & C’s of each offer to ensure fairness and transparency, especially when it comes to rollover requirements.

Payment methods

Payment methods need to not only be efficient and safe, you need to be able to access your preferred payment option without any hassles. While all of our recommended NM sportsbooks feature a number of common payment options such as Visa, MasterCard, and American Express, options like Person2Person won’t be available at all bookies. You’ll need to go through this guide and see what each offers and whether it works for you or not. In addition, you’ll notice that practically every one of our top sportsbooks will offer Bitcoin and other cryptocurrencies. This is a growing trend worldwide, and you’ll also notice that you can get up to 25% more in bonus money when using Bitcoin and other cryptocurrencies to make your deposits.

Live betting & streaming

While virtually all sports betting sites will offer live betting these days, not every bookie will feature live streaming of in-play events. If being able to watch a game in real-time as you’re betting is important to you, choose a sports betting site like BetOnline or Intertops. These sites regularly feature live streaming of popular sporting events in NBA, NFL, and other top sports. In addition, live betting should be easy to use and accessible across a variety of platforms including mobile betting.  Betting markets should reflect the spirit and intention of the live betting platform, and offer plenty of scope and dynamic options that move with the live-action as it unfolds.

Licensing & security

All reputable online sportsbooks must feature licensing through recognized industry regulators such as Kahnawake, Curacao, Panama, Gibraltar, UKGC, and Malta. This ensures that the sportsbook that you choose to bet at is covered by strict laws and codes of conduct. It also ensures that you are covered in terms of recourse, should the need arise. Similarly, all of our recommended top NM sportsbooks feature state-of-the-art SSL digital encryption and other security measures, to ensure that your personal information and payment data is always encrypted online.

Sportsbooks at New Mexico Casinos

Brick and mortar gambling New Mexico casinos are starting to expand and include in-person sports betting facilities. It won’t come as any surprise to New Mexico residents that the Santa Ana casino was the first to offer in-person sports betting at their ‘The Star’ sportsbook. Other top NM casinos that now feature sports betting include Buffalo Thunder Resort (Thunder Race & Sportsbook), Isleta Resort and Casino, Inn of the Mountain Gods Resort & Casino (Sportsbook at the Inn).

Are Online Casinos Legal in New Mexico?

Online casinos are always in a bit of a grey area when it comes to gambling legislation, and New Mexico is no different. The state has not officially enacted legalized online gambling as yet. However, it also does not refer to any online casino activity within its gambling statutes. While there are existing laws that apply to online gambling, the state is more concerned with the operators of said online gambling establishments, and not the players.

DFS in New Mexico

DFS, or Daily Fantasy Sports, is hugely popular throughout the US, and we often get NM residents asking if DFS is in fact legal in the state of New Mexico. The answer is yes, provided that you are over the age of 18 years, you can participate in Daily Fantasy Sports betting online. There are plenty of great online sites offering legal DFS betting, including DraftKings and FanDuel. It is also worth noting that DFS in New Mexico is overseen by the Fantasy Sports Trade Association, as well as by the US Gaming Commission.

Horse Racing Betting in New Mexico

Horse race betting is one of the most popular forms of sports betting in New Mexico, both at brick and mortar establishments and online. If you enjoy the brick and mortar experience, there are three main horse race tracks in New Mexico:

  • La Mesa Park NM
  • Ruidoso Downs Race Track NM
  • Sunland Park Racetrack & Casino NM

However, if you enjoy the safety and the convenience of online horse race betting, one of your best options will be BUSR (BetUSR), which offers fantastic online horse race betting coverage, with great horse race betting markets, horse race betting rebates, and fantastic bonuses all round.
